Booking and Reservation Terms

Booking Process

When you make a booking with Maravial Yacht Tours, you are entering into a contract with us. A booking is confirmed once you have received a booking confirmation from us, typically via email, and we have received your deposit or full payment, as required.

All bookings are subject to availability and we reserve the right to decline any booking at our discretion.

Booking Requirements

The lead person making the booking must be at least 21 years of age and possess the legal authority to make the booking. By making a booking, you confirm that you have the authority to accept these Terms and Conditions on behalf of all members of your party.

You will be required to provide full details of all guests in your party, including names, ages, nationality, and any special requirements. For maritime safety and regulatory compliance, this information must be accurate and complete.

Payment Terms

To secure a booking, a deposit of 50% of the total charter fee is required at the time of booking. The remaining balance is due 60 days prior to the charter start date. For bookings made less than 60 days before the charter start date, full payment is required at the time of booking.

Payment can be made by credit card, debit card, or bank transfer. All payments must be made in Canadian Dollars unless otherwise specified in your booking confirmation.

Additional charges, such as fuel surcharges, crew gratuities, or other services requested during your charter, may be charged separately and are not included in the charter fee unless explicitly stated in your booking confirmation.

Security Deposit

For certain yacht charters, a security deposit may be required to cover potential damages or additional expenses. The amount of the security deposit will be specified in your booking confirmation. The security deposit will be refunded within 14 days after the end of your charter, less any deductions for damages, missing items, excessive fuel consumption, or other charges incurred during your charter.

Cancellation and Modification Policy

Cancellation by You

If you need to cancel your booking, you must notify us in writing. Cancellation fees will apply as follows:

  • Cancellations made more than 90 days prior to the charter start date: 25% of the total charter fee
  • Cancellations made 60-90 days prior to the charter start date: 50% of the total charter fee
  • Cancellations made 30-59 days prior to the charter start date: 75% of the total charter fee
  • Cancellations made less than 30 days prior to the charter start date: 100% of the total charter fee

We strongly recommend that you obtain comprehensive travel insurance that includes cancellation coverage.

Modifications by You

If you wish to make changes to your booking, such as dates, yacht, or number of guests, we will do our best to accommodate your request, subject to availability. A modification fee may apply, and if the changes result in a higher charter fee, you will be required to pay the difference.

Modifications requested less than 60 days prior to the charter start date may be treated as a cancellation and rebooking, and cancellation fees may apply.

Cancellation or Modification by Us

In rare circumstances, we may need to cancel or modify your booking due to factors beyond our control, such as weather conditions, mechanical issues, or force majeure events. In such cases, we will offer you the following options:

  • An alternative yacht of similar or superior standard
  • Alternative dates for your charter
  • A full refund of all monies paid

We will not be liable for any additional expenses or losses you may incur as a result of such cancellations or modifications, including but not limited to travel expenses, accommodation, or loss of holiday time.

During Your Charter

Captain's Authority

The captain of the yacht has full authority over the yacht, crew, and all passengers. The captain's decisions regarding safety, navigation, itinerary, and weather conditions are final. You and all members of your party must comply with the captain's instructions at all times.

The captain has the right to terminate your charter without refund if you or any member of your party:

  • Engages in illegal activities
  • Behaves in a manner that endangers the safety of the yacht, crew, or other passengers
  • Repeatedly disregards the captain's instructions
  • Causes significant damage to the yacht or its equipment

Itinerary and Weather Conditions

While we will make every effort to follow your preferred itinerary, the actual route and schedule may be affected by weather conditions, maritime regulations, or other factors beyond our control. The captain has the final authority to determine the itinerary based on safety considerations.

If weather conditions make it unsafe to proceed with your charter or significantly restrict the planned itinerary, we will work with you to find an acceptable alternative, which may include:

  • Modifying the itinerary to navigate in protected waters
  • Postponing departure until conditions improve
  • Rescheduling your charter for alternative dates (subject to availability)

No refunds will be given for itinerary changes or activities canceled due to weather conditions or other factors beyond our control once the charter has commenced.

Your Responsibilities

During your charter, you and all members of your party are responsible for:

  • Complying with all applicable laws and regulations, including maritime laws and customs regulations
  • Respecting the yacht, its equipment, and furnishings
  • Behaving in a manner that does not disturb other passengers, crew, or other vessels
  • Following safety instructions and wearing life jackets when required
  • Ensuring that children are supervised at all times
  • Not bringing illegal substances, weapons, or hazardous materials onboard

You will be held financially responsible for any damage caused to the yacht or its equipment due to negligence, misuse, or failure to follow instructions.

Liability and Insurance

Our Liability

Maravial Yacht Tours maintains comprehensive insurance coverage for our yachts and operations. However, our liability to you is limited as follows:

We do not accept liability for any injury, illness, death, loss, damage, expense, cost, or other claim of any nature which results from:

  • Your own acts or omissions or those of any member of your party
  • The acts or omissions of third parties not connected with the provision of your charter
  • Unusual or unforeseeable circumstances beyond our control
  • Events which we or our suppliers could not have foreseen or forestalled even with all due care

Our liability, except in cases involving death or personal injury, is limited to the total cost of your charter.

Your Insurance

We strongly recommend that you obtain comprehensive travel insurance that includes coverage for:

  • Cancellation and curtailment
  • Medical expenses and repatriation
  • Personal liability
  • Personal belongings and money
  • Adventurous activities you plan to undertake during your charter

We reserve the right to request proof of insurance before the start of your charter.

Complaints and Dispute Resolution

During Your Charter

If you have any complaints or concerns during your charter, please bring them to the attention of the captain or crew immediately. Most issues can be resolved promptly when brought to our attention without delay.

After Your Charter

If you have a complaint that was not resolved during your charter, please submit it in writing to our customer service team within 28 days of the end of your charter. Your complaint should include:

  • Your booking reference number
  • A detailed description of the issue
  • Any supporting documentation or evidence
  • The resolution you are seeking

We will acknowledge your complaint within 7 days and provide a full response within 28 days. If we need more time to investigate your complaint, we will keep you informed of our progress.

Dispute Resolution

If we are unable to resolve your complaint to your satisfaction, you may have the right to refer the matter to mediation or arbitration under applicable consumer protection laws. These Terms and Conditions are governed by the laws of British Columbia, Canada, and any disputes will be subject to the exclusive jurisdiction of the courts of British Columbia.

Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on our website and will take effect immediately upon posting. It is your responsibility to review these Terms and Conditions periodically.

For bookings already confirmed, the Terms and Conditions in effect at the time of booking will apply, unless we are required to make changes due to legal or regulatory requirements.
